Before Starting an Ontario Small Claims Court Case

A court claim is a process, not only a form. Before filing, take time to identify the correct parties, organize the proof, consider the amount claimed and think about whether a judgment could be collected.

  • Confirm the full legal names and reliable contact information for every party.
  • Create a dated chronology and preserve agreements, invoices, messages, photographs and payment records.
  • Consider negotiation or mediation where appropriate before committing time and filing fees.
  • Plan for enforcement: winning a judgment does not itself guarantee payment.

As of October 1, 2025, Ontario describes Small Claims Court as handling eligible claims up to $50,000, excluding interest and costs. Always confirm current rules before acting.
